REFUND & CANCELLATION POLICY

1. INTRODUCTION

This Refund & Cancellation Policy governs the purchase, cancellation, and refund of digital Gift Cards, Voucher Codes, and Coupons issued via the WoveGifts platform.

WoveGifts is a trading name of My Perks (Pty) Ltd, a company registered in the Republic of South Africa.

This Policy must be read together with our Terms and Conditions.

2. LEGAL FRAMEWORK

This Policy is drafted in accordance with:

  • The Consumer Protection Act 68 of 2008 (CPA)
  • The Electronic Communications and Transactions Act 25 of 2002 (ECTA)
  • Applicable South African consumer protection laws

3. NATURE OF PRODUCT

3.1 All Gift Cards, Voucher Codes, and Coupons sold via WoveGifts are:

  • Digital products
  • Delivered electronically
  • Prepaid stored-value instruments
  • Redeemable at participating third-party merchants

3.2 Once issued, a Voucher Code or Gift Card Code represents a unique digital instrument capable of immediate redemption.

4. RIGHT TO CANCEL - ELECTRONIC TRANSACTIONS (ECTA)

4.1 In terms of Section 44 of ECTA, consumers purchasing goods or services online generally have a 7-day cooling-off period.

4.2 HOWEVER, in terms of Section 42(2)(f) of ECTA, the cooling-off right does NOT apply to:

"Services which began with the consumer's consent before the end of the seven-day period."

4.3 By purchasing a Gift Card or Voucher Code and proceeding to digital issuance, the consumer:

  • Explicitly consents to immediate electronic delivery; and
  • Acknowledges that the right of cancellation falls away once the digital code is issued.

4.4 Accordingly, once a Gift Card or Voucher Code has been issued or delivered, it may not be cancelled under the ECTA cooling-off provisions.

5. GENERAL REFUND POLICY

5.1 Once a Gift Card, Voucher Code, or Coupon has been:

  • Issued
  • Delivered
  • Accessed
  • Viewed
  • Or partially or fully redeemed

It is strictly non-refundable and non-cancellable.

5.2 Gift Cards and Voucher Codes cannot be:

  • Exchanged for cash
  • Returned for cash
  • Converted into bank transfers
  • Credited to alternative payment methods

5.3 No refund will be granted for:

  • Change of mind
  • Incorrect selection of merchant
  • Incorrect denomination selection
  • Incorrect recipient email or mobile number provided by purchaser
  • Failure to use the code before expiry

6. CANCELLATION BEFORE ISSUANCE

6.1 If a purchaser requests cancellation BEFORE a Gift Card or Voucher Code has been issued and delivered, WoveGifts may, at its sole discretion:

  • Cancel the transaction; and
  • Refund the purchase amount less payment processing fees where applicable.

6.2 Once the digital code has been generated and dispatched, cancellation is no longer possible.

7. DEFECTIVE, DUPLICATE OR INVALID CODES

7.1 If a Gift Card or Voucher Code is:

  • Technically defective
  • Not functional upon first attempted redemption
  • Incorrectly generated

The purchaser must notify WoveGifts within 7 (seven) days of purchase.

7.2 Upon verification, WoveGifts may:

  • Reissue a replacement code; or
  • Credit the correct balance to the user's account.

7.3 WoveGifts reserves the right to investigate any claim prior to reissuing value.

8. REFUNDS FOR GOODS OR SERVICES PURCHASED WITH A GIFT CARD

8.1 WoveGifts does not sell physical goods or services directly (unless explicitly stated).

8.2 Any goods or services purchased using a Gift Card or Voucher Code are supplied by third-party merchants.

8.3 Refunds of goods or services are governed exclusively by the merchant's refund policy and the CPA.

8.4 If a merchant approves a refund:

  • The amount will be credited back to the original Gift Card balance where possible; or
  • Reissued as a replacement Voucher Code.

8.5 WoveGifts is not responsible for a merchant's refusal to refund goods.

9. FRAUD, CHARGEBACKS AND PAYMENT REVERSALS

9.1 If a payment used to purchase a Gift Card is:

  • Reversed
  • Charged back
  • Disputed with a bank

WoveGifts reserves the right to:

  • Cancel associated Gift Cards
  • Freeze associated accounts
  • Recover funds from the user

9.2 Fraudulent activity may result in legal action.

10. CORPORATE & BULK PURCHASE REFUNDS

10.1 Corporate and bulk purchases of Gift Cards are subject to the specific contractual agreement entered into with My Perks (Pty) Ltd.

10.2 Unless expressly agreed in writing:

  • Bulk-issued codes are non-refundable once generated.
  • Unallocated codes may be reallocated but not refunded.

11. EXPIRY

11.1 Gift Cards are valid for three (3) years from date of issue unless otherwise specified.

11.2 Vouchers and Coupons are valid for the period stated at issuance.

11.3 Expired Gift Cards or Voucher Codes cannot be reinstated unless required by law.

12. CPA CONSUMER RIGHTS

Nothing in this Policy is intended to limit or exclude rights that consumers are entitled to under the Consumer Protection Act.

Where any provision conflicts with applicable law, the law shall prevail.
