1. INTRODUCTION

These Terms and Conditions ("Terms") govern the purchase, issuance, delivery, acceptance, and redemption of all digital gift cards, voucher codes, and coupons made available through the WoveGifts platform.

WoveGifts is a trading name of My Perks (Pty) Ltd, a private company duly incorporated in the Republic of South Africa ("My Perks", "WoveGifts", "we", "us", or "our").

By purchasing, accepting, redeeming, or using any Voucher Code or Gift Card Code issued via the WoveGifts platform, you agree to be bound by these Terms.

If you do not agree to these Terms, you must refrain from using the website and purchasing any Voucher Codes or Gift Card Codes.

2. DEFINITIONS

For purposes of these Terms:

"Gift Card" means a multi-use digital gift card linked to a unique Gift Card Code representing a pre-loaded monetary value.

"Voucher" means a single-use digital Voucher Code redeemable for a specified product, service, or value at a participating merchant.

"Coupon" means a Voucher Code providing a discount on qualifying goods or services.

"Voucher Code" / "Gift Card Code" means a unique alphanumeric digital code representing stored monetary value or entitlement.

"Merchant" means any third-party retailer, service provider, or partner authorised to accept Voucher Codes or Gift Card Codes.

"Programme" means the WoveGifts digital gifting and voucher distribution ecosystem.

"User" means any person who purchases, receives, or redeems a Voucher Code or Gift Card Code.

3. GENERAL CONDITIONS OF USE

3.1 Voucher Codes and Gift Card Codes may only be redeemed at authorised participating merchants within the Republic of South Africa unless otherwise specified.

3.2 Certain Voucher Codes may only be redeemed at the specific merchant indicated at purchase.

3.3 Gift Cards are valid for three (3) years from the date of issue or the most recent top-up, unless otherwise stated.

3.4 Vouchers and Coupons are valid for the duration specified at the time of issue.

3.5 Voucher Codes and Gift Card Codes:

• Cannot be exchanged for cash
• Cannot be withdrawn for cash
• Cannot be refunded once issued
• May not be resold without written consent

3.6 No cash change will be provided.

3.7 If a purchase exceeds the available balance, the User must pay the difference using another accepted payment method.

3.8 Once a Voucher Code or Gift Card Code has been issued to a specified email address, mobile number, or account, the User accepts responsibility for ensuring the details provided are correct.

3.9 My Perks (Pty) Ltd trading as WoveGifts shall not be liable for codes sent to incorrect recipients due to User error.

4. PURCHASE AND PAYMENT

4.1 All purchases are processed in South African Rand (ZAR).

4.2 Payment must be made in full prior to issuance of any Voucher Code or Gift Card Code.

4.3 WoveGifts reserves the right to delay or cancel issuance where:

• Fraud is suspected
• Payment authorisation fails
• Chargeback risk is identified
• Regulatory compliance checks are required

4.4 Ownership and risk pass to the purchaser or recipient upon successful digital delivery.

4.5 In the event of a payment chargeback or reversal, WoveGifts reserves the right to:

• Cancel associated Voucher Codes
• Suspend accounts
• Recover amounts due

5. REDEMPTION

5.1 The balance of a Gift Card will be reduced by each purchase.

5.2 Some merchants may impose additional terms and conditions governing redemption.

5.3 Users are responsible for reviewing merchant-specific terms before redeeming.

5.4 WoveGifts does not guarantee:

• Product availability
• Merchant stock levels
• System uptime of third-party merchants

5.5 If a merchant's system is offline, redemption may be temporarily unavailable.

6. REFUNDS AND CANCELLATIONS

6.1 Refunds for goods or services purchased using a Voucher Code or Gift Card Code are governed by the merchant's refund policy.

6.2 If a refund is approved by the merchant, the refunded amount will be credited back to the original Voucher Code or Gift Card Code where possible.

6.3 Once issued, Voucher Codes and Gift Card Codes cannot be cancelled or refunded except where required by law under the Consumer Protection Act (CPA).

6.4 Where a Voucher Code has not yet been delivered and a cancellation request is received before issuance, WoveGifts may, at its discretion, reverse the transaction.

7. LOST, STOLEN, OR UNAUTHORISED USE

7.1 Users are responsible for safeguarding their Voucher Codes.

7.2 WoveGifts is not liable for unauthorised use where:

• Codes are shared
• Email accounts are compromised
• Mobile devices are lost

7.3 Once redeemed or expired, codes cannot be replaced.

8. CORPORATE AND API DISTRIBUTION

8.1 WoveGifts may distribute Voucher Codes through:

• Corporate incentive programmes
• Banking or telecom integrations
• API partnerships
• Bulk distribution campaigns

8.2 Where a Voucher Code is issued via a third-party corporate partner, additional partner terms may apply.

8.3 My Perks (Pty) Ltd remains the issuer of record unless otherwise specified.

9. DATA PRIVACY

9.1 Personal information is processed in accordance with:

• The Protection of Personal Information Act (POPIA)
• The Electronic Communications and Transactions Act (ECTA)

9.2 User information will only be processed for:

• Programme administration
• Redemption processing
• Fraud prevention
• Customer support

9.3 WoveGifts may engage authorised third-party processors to facilitate services.

9.4 Personal information will not be sold.

9.5 Users may request access, correction, or deletion of personal data in accordance with applicable law.

10. FRAUD AND MISUSE

10.1 WoveGifts reserves the right to:

• Investigate suspicious activity
• Suspend accounts
• Cancel Voucher Codes
• Refuse transactions

10.2 Any fraudulent use may result in legal action.

11. LIMITATION OF LIABILITY

11.1 To the maximum extent permitted by law, My Perks (Pty) Ltd trading as WoveGifts shall not be liable for:

• Indirect or consequential damages
• Merchant product quality
• Delivery delays beyond reasonable control
• System downtime
• Force majeure events

11.2 WoveGifts' maximum liability shall not exceed the value loaded onto the relevant Voucher Code.

12. INTELLECTUAL PROPERTY

All platform content, trademarks, logos, branding, and system architecture remain the intellectual property of My Perks (Pty) Ltd or its licensors.

Users may not reproduce, distribute, or commercially exploit platform materials without written consent.

13. MODIFICATIONS

WoveGifts reserves the right to amend these Terms at any time. Updated Terms will be published on the website and become effective immediately.

14. GOVERNING LAW

These Terms are governed by the laws of the Republic of South Africa.

Any dispute shall be subject to the jurisdiction of the South African courts.

15. SEVERABILITY

If any provision is found invalid, the remainder shall remain enforceable.
